Planning a surprise proposal is an incredibly special moment, filled with love and excitement. As the photographer entrusted with capturing this magical occasion, it’s crucial for everything to be well-organized and legally protected.

Our Proposal Photography Contract is like your safety net, designed to cover all the bases and give you peace of mind as you capture those unforgettable moments.

Provisions Include:

  • non-refundable payment(with liquidated damages language)
  • payment schedule + completion schedule
  • late fees for late or missed payments
  • pre-proposal consultation preference
  • maximum number of attendees - should they want their friends and family there
  • what happens if the client exceeds the scope of elopement services (such as the number of attendees)
  • party responsibility for securing location access and legalities
  • notification of same-day changes to schedule and location
  • props/materials provided by which party (i.e. roses, balloons)
  • what happens if the proposal recipient declines the proposal
  • what happens if the proposal recipient declines the photography
  • additional contract execution by proposal recipient (i.e. needs to sign a model release)
  • cancellation and rescheduling
  • photographic materials included/defined
  • artist's right of discretion for images
  • copyright and reproductions (whether selling digitals or not)
  • client usage of images
  • safe working environment + cooperation of clients and guests
  • exclusive photographer clause
  • failure to perform

  • venue guidelines and responsibility of the client

What are the Differences in Wedding Contracts?

A common (and GREAT) question is the differences in our wedding services contracts.

Wedding Essentials is the general wedding contract you have with clients.

Destination are full, standard weddings photographed at destination locations (not within your local area - think across or out of country).

Elopements - small scale weddings limiting number of people and activites. These won't typically include full-receptions etc.

  • Can I use these contracts if not in the US?

TheLawTog®’s contract forms are drafted on general American law-based contract principles and are applicable to many states.  Due to variations in law based on location and business policies, the contracts are editable and easily adaptable. If you are a photographer outside the US, the policies may be implemented for your business, but U.S. Federal Copyright laws and other legal theories may not apply.  For example, in the United States, unless otherwise contracted, the photographer retains copyright ownership of images. However, in other countries, the law may give the copyright ownership to the client and necessitate a provision for transfer.
