Portrait Contract – This portrait agreement covers all of the pertinent areas any photography business owner should have to cover themselves legally for a portrait photography session. Includes provisions such as: coverage, payment schedule, completion schedule, rescheduling/cancellation, proofing, artistic rights, etc.

Model Releases-

The download includes two model releases

#1 General Release includes language covering adults and minors

#2 Limited Release includes options to allow the client limit the use of their images by the photographer

Print Release – The print release form is readily customizable to be included with digital file orders to outline the do’s and dont’s that the client can do with your art. This gives the client the permission to print only – does not give permissions for commercial or other uses.  This does reemphasize the copyright laws.

Permission to Sell to a Third Party – This agreement allows the Client to provide the Photographer permission to sell photographs from their photography event to private third-parties.  It also acts to define uses, restrictions on purchasers and specific images that are sold to third-parties. (For example: Parents of the bride/groom, wedding party participants)

Payment Plan Contract –

This photography contract is for use between client and photographer when client has purchased a collection/product/service.

Below you will find the information of file types and programs for products in the shop.

Most products purchased through the shop are .psd, .doc, or .pdf.  Each product is identified with the type of file that they come in.   Please read the following information below to understand how to work these files.

 

Zipped Files

  • Almost ALL products are zipped – which means they are compressed for quicker download.  You MUST unzip these or you will get an error.  There are a ton of tutorials on the internet (Just google your operating system + “unzip files”)
  • If you do not know how to unzip please do not purchase the item.
  • Apple users: Double click item to automatically unzip
  • PC users: Just google your operating system + “unzip files” to find a tutorial for your operating system

 

.PSD – Marketing Templates

These are Photoshop files and canNOT be opened in Lightroom.  They can only be opened in PS or PSE programs.


The Commerical Proposal Template and Client guide are only for Photoshop.  These do not include fonts or a subscription for magazine presentation.  It is recommended to use a program such as ISSUU or FlipSnack to embed the PDF into your site.

 

.Pdf – eBooks

These files require Adobe Acrobat Reader or Preview (Apple users).  Acrobat is a free download here

 

.Doc  – Contracts 

  • Typically opened in Microsoft Word BUT they can be opened a variety of ways without Microsoft Word, such as through Note Pad, Text Edit, Google Docs. Keep in mind – opening in these systems may not show the color coding – just be mindful of notes that we have placed in the contract to help you fill it out.  
  • Tutorial: If you do NOT have Word, press/hold control + click on the file.  A pop up will come up. Choose “Open with” and select the program you want to use.
  • Google Docs Tutorial:  Select File Upload in Google docs.   Choose your downloaded Word doc.  Open it in Google Drive (if you want to edit).
  • Please note: An alternate version of the contract will not be sent. Compatibility and accessibility is responsibility of the user.

 

.xls – Accounting Spreadsheets

It is recommended that Microsoft Excel be used.  It is reported that Numbers will work for this product but we do not provide support for Numbers users.

So how do TheLawTog’s contracts differ from others?

TheLawTog is a barred attorney with experience in business transactional work including contracts and business formations. As a lawyer AND photographer she combines both experiences to provide a well-rounded contract template for use. Since Rachel wears both hats, is able to provide the legal aspects as well as the provisions needed for photographers and small business owners in the creative industry. Many times lawyers can draft for business transactional work but will be missing specific key elements needed for a comprehensive contract because they may not have worked in or with the creative industry previously. These contracts are direct work product of Rachel and go through a screening process with another barred attorney to give maximum results.

 

Should I get template contracts or hire an attorney?

Great question! These contract forms are not state specific as they are drafted on general contract principles and experience as a photography business owner.  I always say that nothing can replace having an attorney (as long as they are knowledgable in contract law + creative industry specifics) BUT the good thing with these template contracts is they can be used out of the box (with your business policy amendments) OR taken to attorney and revised. The great thing with taking the template themselves to an attorney in your area is that you can cut down greatly on contract drafting fees (many areas are 250-500$ an hour just for basic contract drafting), therefore, reducing your overall bill!

 

Do the contracts include model releases?

The model releases are separate as clients may wish to decline. Here’s some more information.

 

How easy is it to use these contracts?

How do I determine which contract I need?

I recommend you start with purchasing the contract for the main type of photography that you do.  The very basic contracts needed are the follows: contract, model release, print release.  After that I suggest the payment plans, product delivery agreement and permission to sell to a third party (particularly weddings).

 

Why are there different types of contracts?

Each type of photography contract has provisions specific to that type of photography. For example: A birth or wedding photography may want to to contract for a required break, whereas, a portrait photography may not necessarily need that. If you work with general portraiture (or multiple types), the general portrait contract is a great place to start.

 

Can I use these in any state or outside the USA?

These contracts are not state specific as they are drafted on general contract principles and experience as a photography business owner.

If you are a photographer outside the US, the policies may be implemented for your business. US Federal Copyright laws would not apply. Always consult an attorney.

 

How do I get my items?

How can I purchase these items?

You can do it by phone or computer, however, it is important to note it is is your responsibility to download the Product immediately and securely back up all purchases – as all links expire 120 hours after purchase for your security. What is the difference between the product delivery agreement and final sale contract?

Final sale is at the in person sales session or when sale ordered. Done final. They know it’s final. Waives the cooling off periods demanded by Federal and State law. Product delivery agreement is accepting the products and is similar to final sale but is acknowledging you’re accepting the products right then.

 

What if I need the items again?

You can remit a $5 resend link fee per the terms to rachel@Thelawtog.com per item. HOWEVER it is the purchasers responsibility to back up these files. This one-time courtesy is at the discretion of the site.

Fine Print

All legal forms are intended to be template guides to be used as-is or to assist in reducing lawyer drafting fees. You must include all your own policies and insert pertinent information that is specific to your business. All contracts are drafted on general contract principles and may be used in any state, however it is not guaranteed that they will abide by specific state law. All template forms and provisions can be amended and applied for your jurisdiction.
